Publishing criteria

Presumption to publish does not permit Public Sector organisations to publish copies of OS MasterMap, AddressBase or any other OS products, or extracts from them.

You've created your own dataset using OS data licensed to you under the Public Sector Geospatial Agreement (PSGA), which you would like to publish on data.gov.uk.

Prior to submitting your notification form, you need to be sure that your derived dataset meets our publishing criteria.

The best “general rule” test we recommend is when you consider your dataset, do you just see an OS dataset with a few tweaks, or do you see a dataset that feels like yours? If your dataset is of the latter type, it is more likely to meet the presumption to publish criteria below but you will still need to check before submitting your notification.

Check you meet our presumption to publish criteria

The following guidance only applies to situations where your dataset contains OS intellectual property (IP). It doesn’t apply to your own data nor data you might want to associate with OS data that is someone else’s intellectual property.

 

Release your dataset under Presumption to Publish

In order to be able to release your dataset under Presumption to Publish, the release needs to meet the following conditions and/or be included in the 'What datasets can I publish that include OS data?' section displayed on the publishing your derived data with confidence page:

  1. Your dataset has been created in order to deliver your Core Business, and its release does not constitute a Competing Activity or Commercial Activity;
  2. whilst your dataset may incorporate IPR from the Licensed Data by copying Features and/or Feature Attribution in part or whole, your dataset shall not include a substantial quantity of Features or Feature Attribution from the Licensed Data used to create it. (In considering the meaning of ‘substantial quantity’, the following factors may be relevant: i) the total quantity of the relevant Features or Feature Attribution in the underlying Licensed Data, by reference to Great Britain as a whole or any of England, Scotland or Wales, and ii) whether your dataset is capable of forming part of a series of connected datasets, whether created by you or other PSGA Members, using Licensed Data)
  3. the dataset is released independently of the Licensed Data used to create it or any other Licensed Data (for example, your dataset must not be released with Licensed Data as a contextual backdrop);
  4. Your dataset must be openly released on the terms of the Open Government Licence (OGL) and published via data.gov.uk; and
  5. You must notify OS of such release in the manner set out below.

Please refer to your PSGA Members Licence for the meaning of the defined terms used above.

OS data containing third party intellectual property

You cannot use presumption to publish if your derived data has been created using any of the following OS products as separate permission will need to be obtained from third party IPR owners:

  • AddressBase
  • AddressBase Core
  • AddressBase Plus
  • AddressBase Premium
  • AddressBase Premium Islands
  • OS NGD Address: GB Address
  • OS NGD Address: Island Address

You will instead need to submit an application under the exemptions process.

Please note that:

    • If address data has been published or made available on open terms by a member without a specific exemption (for example as a result of an error or oversight), this must be remedied immediately by removing the published data from data.gov.uk.
    • Address data can be made available under various terms under the PSGA, for instance the End User Licence or public viewing terms.
    • The above is not intended to contradict anything set out in the OS Open Identifiers Policy.
